Legacylift Commerce UG (haftungsbeschränkt) (“Babylon Berlin”, “we” or “us”) operates this shop and this website, including all related information, content, features, tools, products and services, in order to provide you as a customer with a personalized shopping experience (the “Services”). Our shop runs on WordPress with WooCommerce. This Privacy Policy describes how we collect, use or disclose personal data when you visit or use the website, make a purchase or other transaction using the Services, order from us via a marketplace such as Amazon, or otherwise communicate with us. In the event of any conflict between our General Terms and Conditions and this Privacy Policy, this Privacy Policy shall prevail with regard to the collection, processing and disclosure of your personal data.

Please read this Privacy Policy carefully. By accessing or using any of the Services, you confirm that you have read this Privacy Policy and agree to the collection, use and disclosure of your data as described in this Privacy Policy.

What personal data do we collect or process?

When we use the term “personal data”, we refer to information that identifies you or another person or can be directly associated with you. Personal data does not include information that is collected anonymously or has been anonymized in such a way that identification or association with your person is no longer possible. Depending on how you interact with the Services, where you reside and as permitted or required by applicable law, we may collect or process the following categories of personal data, including inferences drawn from such data:

  • Contact data including name, postal address, billing address, shipping address, telephone number and email address.
  • Financial data including transaction details, payment method, payment confirmation and other payment details, and, if you pay by bank transfer, the account details transmitted to us with the payment. You enter card data directly with Stripe; we do not store it.
  • Account information including username, password, security questions, configurations and settings.
  • Transaction information including items you view, place in your shopping cart, add to your wishlist or purchase, return, exchange or cancel, as well as your past transactions.
  • Communication with us including information you provide when communicating with us, for example when you send a request to customer support.
  • Device information including information about device, browser or network connection, IP address and other unique identifiers.
  • Usage information including information about your interaction with the Services, including how and when you interact with or browse the Services.

Sources of personal data

We may collect personal data from the following sources:

  • Directly from you We collect data when you create an account, access or use the Services, communicate with us or otherwise provide us with your personal data.
  • Automatically via the Services We collect data from your device, when you use our products or Services or visit our website, as well as through the use of cookies and similar technologies.
  • From our service providers We collect data when we engage service providers to enable certain technologies and when they collect or process your personal data on our behalf.
  • From our partners and other third parties for example, we receive data from Amazon when you order from us via Amazon (see “Sales via Amazon”).

How do we use your personal data?

Depending on how you interact with us or which Services you use, we may use personal data for the following purposes:

  • Provision, customization and improvement of the Services. We use your personal data to provide you with the Services. This includes, among other things, fulfilling our contract with you, processing your payments, executing your orders, storing your configurations and items of interest, sending notifications related to your account, creating, maintaining and otherwise managing your account, organizing shipping, facilitating returns and exchanges, enabling you to submit reviews and creating a personalized shopping experience, for example by recommending products based on your purchases. This may also include using your personal data to better customize and improve the Services.
  • Marketing and advertising. We use your personal data for marketing and advertising purposes, for example to send marketing and promotional communications via email, SMS or post, and to display online advertising for products or services on the Services or other websites, including based on items you have previously purchased or placed in your shopping cart, as well as other activities related to the Services.
  • Security and fraud prevention. We use your personal data to authenticate your account, provide a secure payment and shopping experience, detect, investigate or take action against possible fraudulent, illegal, unsafe or malicious activities, protect public safety and ensure the security of our Services. If you choose to use the Services and register an account, you are responsible for protecting your account credentials. We strongly recommend that you do not share your username, password or other access data with others.
  • Communication with you. We use your personal data to provide you with customer support and effective Services, to respond promptly to your inquiries and to maintain our business relationship with you.
  • Legal reasons. We use your personal data to comply with applicable law or respond to lawful procedures, including requests from law enforcement or regulatory authorities, to investigate or participate in civil investigations, potential or actual litigation or other adversarial proceedings, and to investigate potential violations of our terms or policies or enforce those terms and policies.

How do we share personal data?

Under certain circumstances, we may disclose your personal data to third parties for legitimate purposes in accordance with this Privacy Policy. Such circumstances may include:

  • We share personal data with service providers who act on our behalf or are involved in processing your order: our hosting provider (see “Hosting and shop system”), our fulfillment partner Acut and the shipping company (see “Shipping and fulfillment”), our payment provider Stripe (see “Payment processing”) and our web agency Navus, UAB Vilhelmo Berbomo St. 10, LT-92221 Klaipeda, which maintains the shop technically and only accesses personal data where this is necessary to fix a reported problem. We have data processing agreements under Art. 28 GDPR with the hosting provider, Acut and navus. Further recipients are named in the sections “Google Analytics” and “Cloudflare Turnstile”.
  • When you request us or otherwise consent to share certain information with third parties, for example to deliver products to you or when you use social media widgets or login integrations.
  • We share personal data with our affiliates or otherwise within our corporate group.
  • In connection with a business transaction such as a merger or insolvency, to comply with applicable legal obligations (including responding to subpoenas, search warrants and similar requests), to enforce applicable terms of service or policies and to protect or defend the Services, our rights and the rights of our users or others.

Hosting and shop system

Our online shop is based on WordPress with WooCommerce and is hosted by [hosting provider, address]. When you visit the shop or place an order, personal data (e.g. IP address, order and contact data) is stored on the hosting provider’s servers in Germany. We have a data processing agreement with the hosting provider under Art. 28 GDPR. The legal basis is Art. 6(1)(b) and (f) GDPR (performance of a contract and our legitimate interest in operating the shop securely).

Sales via Amazon

We also sell our products via the Amazon.de marketplace, operated by Amazon EU S.à r.l., 38 avenue John F. Kennedy, L-1855 Luxembourg. When you order via Amazon, Amazon provides us with the data needed to process the order: name, delivery address, telephone number, an anonymized email address assigned by Amazon, and the items ordered and price. This data is transferred to our shop system via an interface and processed solely for shipping, invoicing and compliance with tax obligations (Art. 6(1)(b) and (c) GDPR). We delete or anonymize name, address, telephone number and email address no later than 30 days after delivery; we retain invoice data for the statutory periods (see “Security and retention of your data”). Amazon’s own processing is governed by Amazon’s privacy notice.

Shipping and fulfillment

Packing and shipping of our orders is handled on our behalf by [Acut – company name, address]. For this purpose, Acut receives your name, delivery address and the items ordered; we have a data processing agreement with Acut (Art. 28 GDPR). For delivery, we pass your name and delivery address to the shipping company, usually DHL Paket GmbH, Sträßchensweg 10, 53113 Bonn, Germany (Art. 6(1)(b) GDPR). We only pass on your email address and telephone number if you gave your consent when placing the order, so that the shipping company can notify you about the delivery (Art. 6(1)(a) GDPR). You can withdraw this consent at any time with effect for the future.

Payment processing

We process online payments via Stripe (Stripe Payments Europe, Ltd., Dublin, Ireland). For this purpose, we transmit the data required for the payment (name, billing address, email address, amount); you enter card data directly with Stripe, and we do not store it. If you pay by bank transfer, we process the account details transmitted to us with the payment. The legal basis is Art. 6(1)(b) GDPR. For orders via Amazon, Amazon processes the payment; we do not receive any payment data.

Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to websites that are not affiliated with or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not guarantee and are not responsible for the privacy or security of such websites, including the accuracy, completeness or reliability of the information contained on those websites. Information you provide in public or semi-public places, including information you share on third-party social networking platforms, may also be visible to other users of the Services and/or users of those third-party platforms without limitation as to its use by us or a third party. The inclusion of such links does not imply endorsement of the content of such platforms or their owners or operators, unless expressly stated in the Services.

Data from children

The Services are not intended for use by children, and we do not knowingly collect personal data from children who have not reached the age of majority in your country. If you are the parent or guardian of a child who has provided us with their personal data, you may contact us using the details below to request deletion of such data. As of the effective date of this Privacy Policy, we have no knowledge that we “share” or “sell” (as defined under applicable law) personal data of individuals under 16 years of age.

Security and retention of your data

Please note that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security”. Additionally, any information you send to us may be at risk during transmission. We recommend that you do not use insecure channels when transmitting sensitive or confidential information to us.

We store personal data only for as long as is necessary for the respective purpose:

  • Order and customer data: until the order has been fully processed and the warranty periods have expired; customer accounts until they are deleted.
  • Data from Amazon orders (name, address, telephone number, email address): deleted or anonymized no later than 30 days after delivery.
  • Invoices and accounting records: for the statutory retention periods under Section 147 of the German Fiscal Code (AO) and Section 257 of the German Commercial Code (HGB) (currently up to 10 years).
  • Server and security logs: 30 days.

Google Analytics

This website uses Google Analytics 4, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The measurement ID used is G-LJ3EDMLCZH.

Google Analytics uses cookies and comparable technologies to analyse how our website is used. Among other things it processes your shortened IP address, information about your browser and device, the pages you view, time spent and interactions, as well as pseudonymous identifiers. This helps us understand how the website is used and improve it.

The legal basis is your consent under Art. 6(1)(a) GDPR and Section 25(1) TDDDG. No data is collected through Google Analytics without your consent: we use Google Consent Mode v2, so no analytics data is sent to Google before you agree. You can withdraw your consent at any time with effect for the future through the cookie settings on this website.

Cloudflare Turnstile

To protect our contact forms against misuse and spam we use Turnstile, a service provided by Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA.

Turnstile checks whether a form submission comes from a human rather than an automated program. Your IP address, information about your browser and device and your interaction with the website are transmitted to Cloudflare and evaluated there. Turnstile does not set advertising cookies and does not build cross-site user profiles.

The legal basis is Art. 6(1)(f) GDPR: we have a legitimate interest in protecting our forms from automated requests and spam. The transfer to the USA is based on the standard contractual clauses of the European Commission.

International transfers

Please note that we may transfer, store and process your personal data outside your country of residence.

If we transfer your personal data outside the European Economic Area or the United Kingdom, we rely on recognized transfer mechanisms such as the European Commission’s Standard Contractual Clauses or equivalent contracts issued by the relevant authority in the United Kingdom, unless the data transfer is to a country that has been determined to provide an adequate level of protection.
